Supreme Court Affirms Birthright Citizenship, Delivering Setback to Trump Administration

The United States Supreme Court recently declined a challenge to birthright citizenship, thereby preserving the long-held constitutional understanding that most individuals born within U.S. borders are automatically granted citizenship. This includes children whose parents may be present in the country without authorization or on a temporary basis.

This decision represents a notable reversal for the former administration, which had made efforts to curtail birthright citizenship a central component of its immigration platform.

Early in his term, the former president had issued an executive directive aimed at eliminating birthright citizenship for children born in the United States to parents who were either residing in the country unlawfully or were temporary visitors.

Legal Challenge to the Policy

The executive order prompted numerous legal actions. Following the Supreme Court's move to restrict the widespread application of nationwide injunctions, the American Civil Liberties Union (ACLU) initiated a national class-action lawsuit. This suit was brought on behalf of families impacted by the policy and was led by a Honduran woman, identified only as "Barbara" to safeguard her identity. The legal challenge asserted that the executive order was unconstitutional and violated the 14th Amendment's guarantee of birthright citizenship.
